LEGAL TERMS AND CONDITIONS FOR THE “PALLADIUM REWARDS ANNIVERSARY PRIZE DRAW” by PALLADIUM GESTIÓN, S.L.U., October 8, 2024
1. Company organizing the Prize Draw
PALLADIUM GESTIÓN, S.L.U., with a registered office on Avda. de Bartolomé Roselló, 18, 07800 Ibiza, Balearic Islands, Spain, with tax identification number B-16.652.760 (hereinafter “Palladium”) is organizing a draw called PALLADIUM REWARDS ANNIVERSARY PRIZE DRAW (hereinafter the “Draw”) subject to these terms and conditions, to reward the loyalty of the members of the loyalty program known as Palladium Rewards, a program which rewards stays and purchases by its members in hotel establishments managed by Palladium or its business group, by assigning points that can be used for stays or purchases in those establishments (the “Program”).
2. Duration, requirements and mechanics of the Prize Draw
The Prize Draw will run for the period from 00:01 a.m. on October 08, 2024 (“Start Date of the Prize Draw”) to 12:00 midnight on October 22, 2024 (“End Date of the Prize Draw”) (“Duration of the Prize Draw”).
Any physical person aged EIGHTEEN YEARS (18) or over may participate in the Prize Draw. You must be registered in the Program to participate in the Prize Draw. All members already registered in the Program at the time the Prize Draw is announced, as well as those who register after the Prize Draw is announced for the sole purpose of taking part in it, can participate.
To participate, you simply need to express your desire to take part:
-Users who are not registered in the Program will receive an email through any of the brands owned by Palladium in which they were previously registered. The email will contain a link that the unregistered user can use to register in the Program and enter the promotional code provided for the purpose of participating in the Prize Draw. Having registered and entered the promotional code, the user will be considered to have expressed their wish to participate.
-Users already registered in the Program will receive an email to allow them to register for the Prize Draw. To express your wish to participate, you must first click on the “I WANT TO ENTER” button in the email. This will direct the user to a website where the user must enter their email associated with the Program and, finally, click on “I WANT TO ENTER” again.
3. Drawing the winners
During the Prize Draw's Duration, the easypromosapp platform will register all the Participants each day and on the final date of the Prize Draw, will randomly draw four (4) winners and eight (8) substitutes.
Within no more than ten (10) calendar days of the end of the Prize Draw Duration, Palladium will contact the winners using the email in the Program's database to notify them of the results.
If the winners do not answer the email within three (3) days, the Prize will go to the Substitute.
4. Prize – General Conditions
Those Participants who win, in accordance with the records reported by the easypromosapp platform, will receive 250,000 Rewards points (the “Prize”), the equivalent of €/$1,000 in points, that can be redeemed for accommodation and purchases at any establishment under the following Palladium Hotel Group brands that accepts Rewards points.

- Only You Hotels (except Only You Hotel Málaga)
- TRS Hotels
- Grand Palladium Hotels & Resorts
- Palladium Hotels

The Prize will be transferred to the Palladium Rewards account of each winner within a maximum of thirty (30) calendar days of the end of the Draw Duration date (“Prize Transfer Deadline"). The Rewards points transferred as a Prize will be valid for nine (9) months from the date on which they are transferred to the winner’s account.
The Rewards points that have not been used by the winner within nine (9) months of being awarded will be automatically removed from their Program account.
If the winner has left the Program (i) before being notified of being named winner or (ii) before the Prize Transfer Deadline is reached, the Prize will be transferred to the person in the next position in line with the records reported by the easypromosapp platform, and if that person has left the Program before the deadlines described in points (i) and (ii), the Prize will be transferred to the third position, and so on and so forth. This process will also be applicable if there is any error in the data provided by the winning Participant that prevents them from being identified or localized.
5. Reservations and limitations
Palladium shall not accept any liability if there are any errors in the data provided by the Participants that could prevent them from being identified or localized if named winners.
Palladium shall not accept any liability for damages of any kind that could result from the lack of availability or continuity of operations of the supports through which participation in the Prize Draw is enabled and/or that allow their development and/or conclusion, especially including, but not limited to, problems accessing the online systems and platforms used for that purpose.
Palladium reserves the right to eliminate for due cause any Participant who defrauds, alters, or disables the correct operation and normal course and rules of the Program and/or Prize Draw.
Palladium reserves the right to shorten, delay, change, or cancel the Prize Draw under exceptional circumstances that prevent it from being held or continued, and will notify the Participants of this. Likewise, Palladium accepts no liability whatsoever for damage or loss incurred while making use of the Prize.
Palladium will not take responsibility for cases of Acts of God that might prevent winners from fully or partially enjoying their Prize.
6. Data protection
In line with the provisions of the valid regulations on personal data protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and Organic Law 3/2018 of December 5 on the Protection of Personal Data and guarantee of digital rights, Participants of the Draw are hereby informed that their data will be processed by Palladium Gestión, S.L.U. as data controller, registered office Avda. Bartolomé Roselló, 18, Ibiza, Balearic Islands, Spain.
Participant data will be those identifying data needed to participate in the Prize Draw.
The purpose of the processing is to undertake the Prize Draw, as well as to publish the winners and then proceed to deliver the Prize. The basis for legitimacy is the express acceptance of these rules for the interested party to participate in the Prize Draw.
Their data will not be provided to third parties except when legally obliged to by:
· the State Tax Administration Agency to fulfill tax obligations related to the Contest, if applicable,
· the administrative authorities that might require it within the framework of compliance with the legal obligations of the data controller or within the framework of any proceedings that may be opened by them in relation to Participant claims, or
· the competent legal authorities.
Participant data will be held while this Prize Draw is being processed. They will be frozen for the legally established period to meet the requirements of any possible claims.
The winners’ data, including those whose entries eventually prove unsuccessful, will also be held for the time needed to manage the Prize’s delivery, the publication of the results of the Prize Draw, as well as to comply with the legal, tax, and administrative requirements related to the Draw. Afterwards, they will be frozen for the legally required periods for possible tax and administrative liabilities, as well as legal actions that might derive from them and the promotion.
Participants can exercise their rights of access, rectification, suppression, limitation, portability, and, if appropriate, opposition, as well as cancel the consent granted.
To exercise your rights, please send a letter to the postal address indicated above or an email to rgpd@palladiumhotelgroup.com. Please specify which of the rights you would like to exercise and attach an image of your national ID or another equivalent ID document. If you act through a legal or voluntary representative, please provide documentation that accredits that representation and their ID.
Furthermore, if you consider that your right to the protection of personal data has been violated, you may lodge a complaint with the Spanish Data Protection Agency (www.agpd.es).
7. Acceptance of the terms and conditions
The Participant accepts these rules in advance, stating that acceptance by expressly consenting to their participation in the Prize Draw.
8. Period claims accepted
Any kind of claim related to the Prize Draw and these rules must be submitted within thirty (30) calendar days of the Prize Transfer Deadline. No claim whatsoever related to this matter will be accepted after that.
9. Law and jurisdiction
These terms and conditions are governed by Spanish common law. For any concern that may arise regarding their interpretation, the parties submit themselves to the jurisdiction of the courts and tribunals of the city of Ibiza, Balearic Islands, Spain, expressly waiving any other jurisdictional privilege to which they may be entitled.
